Real work is paid work
The FLSA defines “employ” as “to suffer or permit to work”. If a candidate serves customers or cares for patients, those hours are generally paid, whatever you call them.

Shadowing means no work
Washington’s L&I says unpaid job shadowing is acceptable only with close supervision and little or no work. California allows unpaid “try-out time” only as a short skills test that gives you no productivity.

Check registries first
Medicare- or Medicaid-certified nursing homes must check the state nurse aide registry before someone works as a nurse aide.
